Terms of service

01.Agreement and service scope
These terms apply to the WPGeared website and services unless a signed proposal, statement of work, order, or other written agreement states different terms. A project begins only after scope, price, responsibilities, and any required payment are confirmed in writing.
Website descriptions and starting prices are informational. They are not an automatic acceptance of work or a promise that a particular site fits the published scope.
02.Estimates, payment, and taxes
Quotes are based on the information available at the time. New requirements, hidden site conditions, unavailable access, third-party changes, or work outside the agreed scope may require a revised estimate or change order before work continues.
Payment schedule, currency, renewal, commitment, cancellation, and refund terms are stated in the applicable proposal or invoice. Clients are responsible for applicable taxes, bank charges, provider fees, premium software, hosting, and other costs unless the written scope says they are included.
03.Client responsibilities
Clients must provide accurate requirements, timely feedback, content, approvals, lawful materials, and authorized access. The client is responsible for maintaining ownership and recovery access for domains, hosting, email, analytics, payment, and other business accounts.
Do not submit passwords, private keys, card information, or production credentials through public forms. When access is needed, use temporary, least-privilege accounts and the sharing method agreed for the project.
04.Third-party services
WordPress projects commonly depend on hosting companies, domain registrars, plugins, themes, APIs, app stores, payment processors, analytics tools, advertising platforms, and other providers. Their availability, pricing, policies, security, and future changes are outside WPGeared's control.
WPGeared may recommend or configure a third-party service, but the client remains responsible for reviewing and accepting that provider's terms unless a written agreement states otherwise.
05.Changes, review, and acceptance
WPGeared may use staging, backups, and a rollback plan where appropriate. The client must review delivered work within the review window stated in the proposal and report reproducible issues related to the agreed acceptance criteria.
Requests that change approved design, content, features, integrations, data, or business rules are additional scope. Maintenance and support plans do not automatically include redesigns, new features, major migrations, or repair of pre-existing conditions.
06.Ownership and licenses
The client retains ownership of client-provided content, trademarks, and data. Subject to full payment, ownership or license rights for custom project deliverables are handled as stated in the proposal. WPGeared retains ownership of pre-existing tools, reusable methods, internal systems, know-how, and third-party or open-source components remain under their existing licenses.
WPGeared will not publish confidential client material as a case study without permission. Public websites may be referenced in a portfolio unless the written agreement restricts that use.
07.Performance, security, and search results
Unless expressly stated in a signed agreement, services are provided using reasonable professional care but without a guarantee of uninterrupted availability, complete security, search ranking, revenue, conversion rate, accessibility certification, app-store approval, or a fixed PageSpeed or Core Web Vitals result.
Metrics can change because of traffic, devices, networks, hosting, content, advertising, analytics, third-party scripts, software updates, and changes made after handoff.
08.Suspension and termination
WPGeared may pause work for overdue payment, missing access, prolonged lack of feedback, unsafe instructions, unlawful content, abusive conduct, or a material change in project risk. Either party may end an engagement under the cancellation terms in the applicable proposal.
On termination, the client remains responsible for approved work performed and non-refundable third-party costs. Handoff, migration, data export, or transition assistance beyond the agreed scope may be quoted separately.
09.Disclaimers and liability
To the extent permitted by applicable law, WPGeared is not responsible for indirect, incidental, special, consequential, or lost-profit damages, or for failures caused by client actions, third-party systems, compromised credentials, unsupported software, or events outside reasonable control.
Any liability cap, warranty period, dispute process, or governing-law provision for a paid project will be stated in the applicable written agreement. Nothing in these terms excludes rights or liabilities that cannot lawfully be excluded.
